Paragard was one of the first IUDs to become available in the US. Doctors have been prescribing this copper IUD for over 30 years, as both a long-term and emergency contraceptive. However, the device has been in the news lately as more women are filing lawsuits against the manufacturer. The lawsuits claim that the manufacturer has failed to adequately warn consumers about severe side effects that can cause permanent organ damage and require surgical intervention.

While labeling and prescribing information from the manufacturer CooperSurgical does mention the possibility of device breakage, it doesn’t mention how often this occurs. The wording of the warning seems to downplay the consequences of an embedded device or one that has perforated the uterus. Women who experience this severe side effect will need at least one surgery to remove the device. In some cases, a complete hysterectomy may be necessary. In addition, other organs can be damaged and fertility may be affected.

Early Paragard Lawsuits
In 2016, Stephanie Ideus was one of the first women to file a lawsuit against Teva Pharmaceuticals, which was Paragard’s manufacturer at the time. Ideus was going through the removal process when the IUD broke and became embedded in her uterus. This required corrective surgery. She claimed that the company was not being transparent about this potential side effect. Her case was finally decided in 2019 when the court sided with Teva and dismissed her case. Despite this ruling, more women are filing suit and trying to hold the company accountable while also receiving compensation for their medical costs.

More recent lawsuits are also focusing on the fact that Teva failed to properly instruct doctors on how to safely remove the device. Currently, there isn’t a class action suit and each claim is being handed separately. Lawyers are representing any woman who has had to undergo surgery because of Paragard. In some states there is only a one to two year window to file suit, so it is important to act quickly.

As it stands now, there have yet to be any settlements for Paragard lawsuits. Lawyers are hoping that these new suits will establish a starting point for negotiations so that clients can receive compensation. However, the courts have yet to side with patients and Paragard is still FDA approved and being widely prescribed to patients. Hopefully, there will be some conclusion to these issues within the coming years and plaintiffs won’t have to wait too long for a resolution.
